KNEE INJURIES

My office has represented numerous clients who have sustained knee injuries as a result of car, motorcycle, bicycle, or even pedestrian accidents. Knee injuries can be very serious and often require surgery or a series of surgeries to assist in recovery.  When someone comes to my office complaining of knee pain, We make sure that, if they have not already been to the emergency room, that the doctor that they go to gets x-rays of the knee and if the client continues to have complaints that they get an MRI of the knee to determine if there is a fracture, a tear in the cartilage, a ligament injury, etc.  Some people experience knee pain immediately and are sent to an orthopedic surgeon right away for an MRI.  But I have also have had cases where clients have come into my office complaining of slight knee pain where over time it became obvious that they had a pretty serious knee injury requiring orthopedic consultation and eventually surgery.

This second set of cases are the toughest ones because often it is assumed that the client only suffered a minor contusion and lawyers fail to send the person for proper orthopedic consultation, which make it very difficult to get compensated for injuries later on.  I can not underestimate the importance of this.  I feel that I owe a duty to my clients to follow up when there is any kind of knee injury and make it a habit to call them at intervals of a week or two weeks after the accident.  Often people stay quiet about continued or worsening pain because they feel that since they have been to the doctor, who did all they could, the pain they are experiencing is just something they are going to have to live with.  But with today’s medical advances, I do not believe that anyone should have to just live with knee pain as a result of an accident.

By following up with these clients, my office is able to help make sure that they get the treatment they need whether it is something conservative like injections or physical therapy, or if there is something that continues to bother them, we send them to an orthopedic surgeon who will see them and evaluate their need for surgery holding billing until after their case is settled.  Knee surgeries can be very expensive, with costs ranging from 25,000-30,000 for just an outpatient arthroscopic surgery.  If a client does not have health insurance to help cover the cost of the surgery, we have arrangements with doctors that will do this type of surgery on a lien basis where the client is not required to pay anything upfront.  Then, if for some reason the settlement is not significant enough to cover the costs, often a result of insurance limits, these doctors will work with us, so that the client will still get a recovery for their injuries.  I work for the client, and I want to make sure that the injured person gets the most money possible in their pocket.  By being diligent with cases involving knee injuries, our office is able to make sure that the client gets the best treatment and a chance at the best possible recovery, not only financially, but physically as well.
