Accidents involving a drunk driver are frequently very severe accidents because often they involve a driver who is impaired while driving and loses control of their vehicle often at very high speeds.  They can be very unexpected because the drunk driver is unpredictable.  He or she might suddenly spin out in front of you, or you might even find the drunk driver driving the wrong way on the freeway.  Some of the injuries are horrendous.  As a drunk driving lawyer, I have had a couple cases in particular that occurred on the freeway involving a wrong way drunk driver.  In one of these such cases, a young couple was driving on the freeway on their way home from a restaurant and a drunk driver driving on the wrong side of the road at a very high speed collided head on with the front of their vehicle. The young woman suffered a very severe fracture of the leg and her husband sustained a variety of minor injuries.  We were able to collect against the drunk driver’s insurance rather quickly.  We collected the maximum covered by the drunk driver’s policy which was 400,000 dollars, though I believe her case was worth well over a million.  She was able to get the care she needed a series of surgeries and fortunately recovered very well from the injuries sustained in this very frightening drunk driver accident.
Another matter involving drunk drivers which is important to understand is that in the state of California we are required to carry liability insurance.  If you do not have liability insurance on your own car, usually you are not permitted to collect from the other party for what we call pain and suffering damages.  You can collect for your medical bills, any loss in wages, and your property damage, but you can not collect for pain and suffering, disability, or things of this nature.  But, when the case involves a drunk driver who caused the accident there is an exception to that law that allows the person who does not have liability coverage to collect even for their pain and suffering.  I had a case like this recently where we had a drunk driver who was out of control.  His car spun out and hit my client.  My client had lost his job a few months before and had been unable to afford his insurance, so he had no insurance whatsoever.  During the accident with the drunk driver he suffered a shoulder injury, a fractured nose, and other assorted injuries.  In this particular case, because the other driver was under the influence he was able to collect for all of his injuries, as well as pain and suffering damages.  He collected well over a hundred thousand dollars, which was only possible because of the fact that the other driver was impaired.  These are horrendous injuries and we have represented many people with regard to drunk driving accidents.
